Not Guilty

Client was charged with Sexual Abuse 3rd Degree after allegedly inappropriately touching another person at a New Year’s Eve party. Sexual Abuse 3rd Degree is a Class A misdemeanor carrying a potential penalty of up to twelve (12) months in jail. During the jury trial, we were able to successfully argue that the client did not form the requisite mental state to commit the crime. After deliberating for an hour, the jury returned a Not Guilty verdict.
