Our client was charged with DUI 4th Offense, which constitutes a Class D felony in Kentucky. His blood alcohol level at the time of arrest was .138. Due to the officer’s violating his rights, the Court suppressed evidence the Commonwealth intended to use against him at trial. After the evidence was suppressed, the Commonwealth dismissed the case.
