Federal Drug Trafficking
Client was charged with Possession with the Intent to Distribute Methamphetamine in the Eastern District of Kentucky. During the arrest, federal authorities interrogated our client in the back of their police vehicle. Despite multiple attempts to invoke his right to have counsel present during the interrogation, law enforcement continued to interrogate him. Based on the client’s statements during the unconstitutional interrogation, the client’s relevant drug weight enhanced his mandatory minimum sentence from 5 years to 10 years. After a suppression hearing, the Court suppressed his statements that were in violation of his constitutional rights, and he was sentenced based on the lower sentencing level.
